Terms of Service

1. Introduction and Acceptance
Welcome to Stacker Tracker. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Present Future Labs Inc. ("Company," "we," "us," or "our"), a corporation incorporated under the laws of British Columbia, Canada.
By accessing or using Stacker Tracker (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.
Your use of the Service constitutes acceptance of these Terms. We may update these Terms from time to time, and your continued use of the Service after such changes constitutes acceptance of the new Terms.
2. Service Description
Stacker Tracker is a personal Lightning Lane stack management tool designed to help Walt Disney World guests track return windows and receive SMS reminders. The Service:
- Allows you to manually log Lightning Lane reservations you have made through official Disney channels
- Calculates estimated grace periods and rebooking eligibility times
- Sends SMS notifications to remind you of upcoming windows and actions
- Provides a dashboard to view and manage your logged reservations
The Service does NOT:
- Book, modify, or cancel Lightning Lane reservations on your behalf
- Access, connect to, or interact with any Disney systems or accounts
- Guarantee the accuracy of grace period estimates or rebooking times
- Guarantee SMS delivery or timing
3. Eligibility
To use the Service, you must:
- Be at least 18 years of age, or be at least 13 years of age with parental or guardian consent and supervision
- Have a valid mobile phone number capable of receiving SMS messages
- Provide accurate and complete information during registration
- Not be prohibited from using the Service under applicable law
4. Account Registration and Security
To use the Service, you must create an account by providing your mobile phone number and verifying it via SMS one-time password (OTP). You are responsible for:
- Maintaining the confidentiality of your account
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or use
- Ensuring your contact information remains accurate and up-to-date
5. Subscription and Payments
Free Tier: The Service offers a free tier that allows you to track up to 2 active Lightning Lanes per day with full SMS notification functionality.
Trip Pass (Paid): The "7-Day Trip Pass" is a one-time purchase of $7.99 USD that removes the lane limit for 7 consecutive days from the date of purchase. Payments are processed securely by Stripe, Inc.
Refund Policy: Due to the time-limited nature of the Trip Pass and the immediate delivery of the service, all sales are final. No refunds will be provided except where required by applicable law. If you experience a technical issue that prevents you from using the Service during your Trip Pass period, please contact us at support@presentfuture.io and we will work to resolve the issue or, at our sole discretion, provide a credit or refund.
Price Changes: We reserve the right to change our pricing at any time. Price changes will not affect existing Trip Passes that have already been purchased.
6. SMS Communications
By creating an account, you expressly consent to receive recurring automated SMS messages from Stacker Tracker at the phone number you provide. These messages are related to your Lightning Lane stack management and may include:
- Return window reminders and alerts
- Grace period expiration warnings
- Rebooking eligibility notifications
- Account verification codes
Message Frequency: Message frequency varies based on the number of Lightning Lanes you add and your park day activity. Typical usage may result in 1-10 messages per active park day.
Costs: Message and data rates may apply depending on your mobile carrier plan. You are solely responsible for any charges from your carrier.
Opting Out: You may opt out of SMS messages at any time by replying STOP to any message. You may also opt out in your account settings or by contacting support. Note that opting out of SMS will significantly limit the functionality of the Service.
Opting Back In: You may opt back in at any time by replying START to our number or updating your settings.
Help: Reply HELP to any message for assistance, or email support@presentfuture.io.
Consent Not Required for Purchase: Consent to receive SMS messages is not a condition of purchasing the Trip Pass. You may use the free tier without purchasing, though the core functionality of the Service relies on SMS delivery.
7. Email Communications
Transactional Emails: By creating an account, you agree to receive transactional emails related to your account, including purchase receipts, security notices, and important service updates. These emails are not marketing messages and cannot be opted out of while maintaining an active account.
Marketing Emails: If you opt in during registration, you may receive occasional marketing emails including tips, product updates, and promotions. Consent to receive marketing emails is not a condition of purchase or use of the Service.
Unsubscribing: You may unsubscribe from marketing emails at any time by clicking the unsubscribe link in any marketing email, toggling off marketing emails in your account settings, or contacting support. Unsubscribe requests are processed immediately.
8. Acceptable Use
You agree to use the Service only for its intended purpose and in compliance with all applicable laws. You agree NOT to:
- Use the Service for any illegal purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to the Service or its related systems
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Use automated scripts, bots, or other automated means to access the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Share your account credentials with others or allow others to access your account
- Resell, sublicense, or commercially exploit the Service without our written consent
- Use the Service in any way that could damage, disable, or impair the Service
- Provide false or misleading information
9. Intellectual Property
The Service, including its original content, features, and functionality, is owned by Present Future Labs Inc. and is protected by international copyright, trademark, and other intellectual property laws.
The Stacker Tracker name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Present Future Labs Inc. You may not use such marks without our prior written permission.
"Lightning Lane," "Walt Disney World," "Magic Kingdom," "EPCOT," "Hollywood Studios," "Animal Kingdom," and all related marks are trademarks of The Walt Disney Company. Stacker Tracker is not affiliated with, endorsed by, or connected to The Walt Disney Company or any of its subsidiaries.
10. User Content
You retain ownership of any data you input into the Service (such as Lightning Lane entries). By using the Service, you grant us a limited license to use, store, and process this data solely for the purpose of providing and improving the Service.
We may use aggregated, anonymized data derived from user activity for analytics, research, and service improvement purposes.
11. Third-Party Disclaimer
No Disney Affiliation: Stacker Tracker is an independent service and is NOT affiliated with, endorsed by, sponsored by, or connected to The Walt Disney Company, Walt Disney World Resort, Disneyland Resort, or any of their subsidiaries, affiliates, or licensees.
Grace Period Disclaimer: The "grace period" referenced in the Service is based on commonly reported observations from the Disney guest community and is NOT an official Disney policy. Grace periods may vary, may not exist for certain attractions, and may change without notice. The Company makes no representations or warranties regarding the accuracy or reliability of grace period information.
No Guarantee: We do not guarantee that following the Service's recommendations will result in any particular outcome at Disney parks. Disney's policies and systems are subject to change at any time.
12. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:
- Scheduled or emergency maintenance
- Technical failures or issues with third-party providers
- Events beyond our reasonable control (force majeure)
SMS delivery depends on third-party carriers and networks. We are not responsible for delays or failures in SMS delivery caused by carrier issues, network congestion, or your device settings.
13. Account Termination
Termination by You: You may delete your account at any time through your account settings or by contacting support. Upon deletion, your personal data will be permanently removed in accordance with our Privacy Policy.
Termination by Us: We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice, including but not limited to if we believe you have violated these Terms.
Effect of Termination: Upon termination, your right to use the Service will immediately cease. Any unused portion of a Trip Pass will not be refunded except where required by law. Sections of these Terms that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, and dispute resolution.
14. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
- WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
- WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY INFORMATION PROVIDED THROUGH THE SERVICE
- WARRANTIES THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS
YOU ACKNOWLEDGE THAT YOU USE THE SERVICE AT YOUR OWN RISK AND THAT WE ARE NOT RESPONSIBLE FOR ANY MISSED RIDES, EXPIRED RESERVATIONS, OR OTHER CONSEQUENCES OF USING THE SERVICE.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INCLUDING THE LAWS OF BRITISH COLUMBIA AND CANADA:
PRESENT FUTURE LABS INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE
- ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE
- UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT
- MISSED RIDES, EXPIRED RESERVATIONS, OR OTHER DISNEY PARK EXPERIENCES
- SMS DELIVERY FAILURES OR DELAYS
- INACCURATE GRACE PERIOD OR REBOOKING ESTIMATES
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR TEN DOLLARS ($10 USD), WHICHEVER IS GREATER.
16. Indemnification
You agree to indemnify, defend, and hold harmless Present Future Labs Inc. and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) your violation of any applicable law.
17. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of British Columbia, Canada, and you consent to the personal jurisdiction of such courts.
18. Dispute Resolution
Before initiating any legal action, you agree to first contact us at support@presentfuture.io and attempt to resolve the dispute informally for at least 30 days.
If the dispute cannot be resolved informally, either party may pursue legal remedies in accordance with the Governing Law and Jurisdiction section above.
19. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:
- Posting the updated Terms on this page with a new "Last updated" date
- Sending you an email notification (if we have your email address)
- Displaying a notice within the Service
Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the Service and delete your account.
20. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions.
21. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Present Future Labs Inc. regarding the Service and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter hereof.
22. Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Present Future Labs Inc.
23. Assignment
You may not assign or transfer these Terms or your rights hereunder, in whole or in part, without our prior written consent. We may assign these Terms at any time without notice or consent in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets.
